Her ‘Health and Thus Her Life’
Perspectives (American Historical Association)
January 2025

Published: An article by Alicia Gutierrez-Romine, associate professor of history, about bans on abortion, and legal exceptions around such bans, in the years before the U.S. Supreme Court's 1973 landmark decision, Roe v. Wade, and what may lay ahead since the high court reversed that decision in 2022 through Dobbs v. Jackson Women's Health Organization. The article (download to read) appears in the American Historical Association's current edition of its flagship magazine.

Gutierrez-Romine wrote, in part, “If fact, in the wake of Dobbs, antiabortion conservatives have bristled commentary on abortion 'bans' and have pointed to exceptions written into the law to indicate that abortions are still legal in the event of life-threatening emergencies. However, history shows that, in practice, the line between protecting a pregnant person’s life and protecting a pregnant person’s health has not always been clear.”
